Terms of Service

These Terms of Service govern your access to and use of the Jeme Finance Inc. planning software, the jemefinance.com website, and any related services (together, the "Service"). Jeme Finance Inc. is a corporation. By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Nature of the Service

The Service is planning software. It lets you build a model of your own financial life and run that model forward. You enter your own figures. The Service then projects those figures across a range of future outcomes using Monte Carlo simulation and historic return sequences, and shows you the range of results rather than a single prediction.

What the software does

Runs one thousand simulated futures against the plan you build, and reports the outcome as a band of results and a probability rather than a single number.
Tests your plan against real historic return sequences so that adverse sequences are represented in the output.
Holds more than one plan at a time and compares two plans side by side when you change a single variable.
Models the order in which a withdrawal is drawn across taxable, tax deferred and tax free accounts, and shows the estimated bracket each portion lands in.
Flags estimated thresholds such as IRMAA brackets and subsidy limits where your modelled income sits close to one.
Exports every assumption and every simulation result to a spreadsheet that remains yours.

What the software does not do

The Service does not link to, connect with, aggregate, or read any bank, brokerage, retirement or other financial account. All figures in your plan are figures you type in yourself.
The Service does not hold, receive, transmit, invest or manage money or securities of any kind.
The Service does not recommend, name, rate or select any security, fund, insurance product or financial institution.
The Service does not produce a recommended asset allocation. Any allocation used in a projection is an assumption you set.

3. Eligibility and Your Account

You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate registration information and to keep your password confidential. You are responsible for all activity that occurs under your account. Notify us at support@jemefinance.com promptly if you believe your account has been accessed without your authorisation.

You are responsible for the accuracy of the figures you enter. The Service cannot detect that a balance, a contribution rate or a spending assumption is wrong, and an inaccurate input produces an inaccurate projection.

4. Plans, Billing, Renewal and Cancellation

The Service is offered on a free plan and on paid subscription plans. Current plans and prices are published on the pricing page and are as follows.

Free. No charge. One saved plan, simulation and historic sequence testing.

Core. $120 per year, or $14 per month. Unlimited plans, side by side comparison, withdrawal order modelling and threshold flags.

Household. $228 per year. Everything in Core, two logins on one shared plan, survivor and single filer projections, and pension and annuity modelling.

Automatic renewal

Paid plans renew automatically at the end of each billing term at the then current price for that plan, charged to the payment method on file, until you cancel. We will send you a renewal reminder before an annual term renews and notice of any price change before it takes effect.

How to cancel

You may cancel at any time from the billing area of your account, using the same online route you used to subscribe. No phone call and no email is required, although you may also write to support@jemefinance.com. Cancellation stops the next renewal. Your paid features remain available until the end of the term you have already paid for.

Refunds

If you cancel an annual subscription within 30 days of the start of a new term and have not exported a plan during that term, we will refund that term in full on request. Monthly subscriptions are not refunded for a partial month. Nothing in this section limits any refund right you have under applicable law.

You are responsible for any applicable taxes. Failed payments may result in suspension of paid features until the balance is settled.

5. Acceptable Use

You agree not to do any of the following:

Use the Service to provide financial planning, investment advice or any other advisory service to a third party for compensation, unless you have purchased a plan that expressly permits professional use.
Copy, scrape, resell, sublicense, or redistribute the Service, its outputs, or its underlying models, other than exporting your own plan data.
Reverse engineer, decompile, or attempt to derive the source code or the simulation methodology of the Service.
Interfere with the Service, circumvent access controls or usage limits, or introduce malicious code.
Upload another person's financial information without that person's permission.

6. Intellectual Property and Licence

The Service, including its software, simulation engine, interface, text and design, is owned by Jeme Finance Inc. and is protected by intellectual property law. Subject to these Terms and to payment of the applicable fees, Jeme Finance Inc. grants you a limited, personal, non exclusive, non transferable, revocable licence to use the Service for your own household planning. The plan data you enter remains yours. You grant us only the limited right to host, process and display that data in order to operate the Service for you.

7. Software, Not Advice

This is the most important term in this agreement. Jeme Finance Inc. is not a registered investment adviser, broker dealer, financial planner, accountant, tax preparer or law firm, and no employee or representative of Jeme Finance Inc. is acting in any of those capacities in connection with the Service.

The Service is provided for educational and informational purposes only. Nothing in the Service constitutes investment advice, tax advice, legal advice, accounting advice, or a recommendation to buy, sell or hold any security or to adopt any particular financial strategy. Every projection is an estimate produced from assumptions you selected. Tax rules, contribution limits, benefit formulas and thresholds change, and the Service may not reflect the most recent change. Past returns, including the historic sequences used in simulation, do not predict future returns.

You should consult a qualified professional who is licensed in your jurisdiction before acting on anything you see in the Service.

8. SMS Messaging - Account Notifications

Jeme Finance Inc. offers an SMS account notification program. By providing your mobile number and opting in, you agree to receive recurring automated account notification text messages about your account and your service at the mobile number provided. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply.

Cancellation and help. You can cancel the SMS service at any time. Just text "STOP" to the short code [INSERT SHORT CODE]. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [INSERT SHORT CODE].
Supported carriers. Carriers supported include AT&T, T-Mobile, Metro PCS, Verizon Wireless, US Cellular, Google Voice, Cellular One, Cellcom, Cellular South, Interop, Clearsky. Carriers are not liable for delayed or undelivered messages.
Cost. Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, contact your wireless provider.
Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. Third Party Services

We use third party providers for hosting, payment processing, email delivery and message delivery. Those providers process data on our behalf under contract. We are not responsible for the acts or omissions of a third party provider beyond our own contractual and legal obligations to you.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT ANY PROJECTION WILL PROVE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JEME FINANCE INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, SAVINGS, INVESTMENT RETURN OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. The state and federal courts located in Mecklenburg County, North Carolina have exclusive jurisdiction over any dispute arising out of these Terms, and you and we each consent to that jurisdiction and venue.

13. Changes to These Terms

We may update these Terms. If a change is material we will notify subscribers by email or through the Service before it takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.
